Ein nicht am Mietvertrag Beteiligter hat keinen Anspruch gegen den Grundsicherungstr\u00e4ger auf \u00dcbernahme der Mietkaution nach dem SGB II. Hieran \u00e4ndert auch das Kopfteilprinzip bei einer gemeinsam bewohnten Wohnung nichts, entschied das Landessozialgericht (LSG) Sachsen<\/a>.<\/p>\n\n\n\n

Ein Mietkautionsdarlehen nach dem SGB XII kann \u00e4lteren oder dauerhaft voll erwerbsgeminderten Personen, die ihren notwendigen Lebensunterhalt nicht oder nicht ausreichend aus eigenen Kr\u00e4ften und Mitteln bestreiten k\u00f6nnen, gew\u00e4hrt werden. Dies kann u. a. nur erfolgen, wenn die Kosten f\u00fcr die begehrte Wohnung angemessen w\u00e4ren. Dies ist nicht der Fall, wenn die Kosten gegen\u00fcber der bisher bewohnten Wohnung zwar niedriger w\u00e4ren, allerdings die Anmietung nicht einem angemessenen Wohnungsstandard entsprechend den Sozialhilfegrunds\u00e4tzen entspricht.<\/p>\n\n\n\n

Hier wollte der Antragsteller eine m\u00f6blierte Wohnung mit einer Komplettausstattung auf gehobenem Niveau mit monatlichem Reinigungsservice anmieten. Das hielt das LSG f\u00fcr unangemessen.<\/p>\n\n\n\n
