Der Gesch\u00e4digte hatte neben einer Monatskarte f\u00fcr \u00f6ffentliche Verkehrsmittel als einziges Fahrzeug ein Motorrad mit Saisonkennzeichen f\u00fcr die sch\u00f6neren Jahreszeiten. Bei gutem Wetter nutzte er dieses Zweirad, bei schlechterem Wetter die \u00f6ffentlichen Verkehrsmittel.<\/p>\n<p>Das Landgericht in der Vorinstanz schloss daraus, dass der Gesch\u00e4digte hinsichtlich des Motorrads keinen dauerhaften Nutzungswillen habe und versagte ihm die Nutzungsausfallentsch\u00e4digung. Der BGH hat das Urteil aufgehoben und die Sache an das Landgericht zur\u00fcckverwiesen. Denn der Gesch\u00e4digte habe einen Nutzungswillen.
