Liegt das Angebot des g\u00fcnstigsten Bieters um mehr als 20 Prozent unter dem des n\u00e4chsten, muss der Auftraggeber in die Ausk\u00f6mmlichkeitspr\u00fcfung einsteigen und das in der Vergabeakte so dokumentieren, dass es die Nachpr\u00fcfungsinstanz nachvollziehen kann. Floskelhafte und oberfl\u00e4chliche Ausf\u00fchrungen des involvierten Ingenieurb\u00fcros reichen nicht. In dem Fall muss das Vergabeverfahren wiederholt werden, so das Oberlandesgericht (OLG) D\u00fcsseldorf<\/a>.<\/p>\n

Das OLG schreibt w\u00f6rtlich: \u201eEine umsichtige, vorausschauend handelnde Vergabestelle wird auf Erl\u00e4uterungen des Bieters nicht verzichten, wenn die Aufgreifschwelle erreicht ist\u201c. Dieser muss dann anhand seiner Kalkulation darlegen, dass der Preis, den er angeboten hat, f\u00fcr ihn ausk\u00f6mmlich ist. Widerspr\u00fcche zwischen der Auftragssch\u00e4tzung und dem Angebot muss die Vergabestelle bzw. das von ihr beauftragte Ingenieurb\u00fcro aufl\u00f6sen.<\/p>\n
