{"id":9068,"date":"2018-04-22T09:42:18","date_gmt":"2018-04-22T08:42:18","guid":{"rendered":"http:\/\/www.ra-herren.de\/?p=9068"},"modified":"2018-04-22T09:42:18","modified_gmt":"2018-04-22T08:42:18","slug":"private-pflegeversicherung-kein-anspruch-auf-sachleistungen-bei-pflegebeduerftigkeit-im-ausland","status":"publish","type":"post","link":"https:\/\/raherren.de\/index.php\/2018\/04\/22\/private-pflegeversicherung-kein-anspruch-auf-sachleistungen-bei-pflegebeduerftigkeit-im-ausland\/","title":{"rendered":"Private Pflegeversicherung: Kein Anspruch auf Sachleistungen bei Pflegebed\u00fcrftigkeit im Ausland"},"content":{"rendered":"<p>Das <a href=\"http:\/\/www.sg-duesseldorf.nrw.de\/\" target=\"_blank\" rel=\"noopener\">Sozialgericht D\u00fcsseldorf<\/a> hat die Klage eines dauerhaft in Spanien lebenden Rentners auf Feststellung eines Sachleistungsanspruchs aus der privaten Pflegeversicherung abgewiesen.|<\/p>\n<p>Der 73-j\u00e4hrige Kl\u00e4ger begehrt von der beklagten privaten Pflegeversicherung die Feststellung, dass er im Fall des Eintritts der Pflegebed\u00fcrftigkeit einen Sachleistungsanspruch (z. B. Erstattung von Rechnungen eines Pflegedienstes, Hilfsmittelrechnungen oder Pflegeheimrechnungen) gegen die Beklagte hat, da dieser einen etwa doppelt so hohen Wert im Vergleich zu einem Pflegegeldanspruch habe. Die Beklagte hatte dem Kl\u00e4ger f\u00fcr den Fall anerkannter Pflegebed\u00fcrftigkeit lediglich die Zahlung von Pflegegeld avisiert.<\/p>\n<p>Die 5. Kammer des Sozialgerichts D\u00fcsseldorf begr\u00fcndet die Abweisung der Klage damit, dass das Pflegegeld uneingeschr\u00e4nkt an Versicherte mit Wohnsitz im EU-Ausland zu transferieren sei, ein Anspruch auf Pflegesachleistungen bzw. auf den entsprechenden Erstattungsanspruch sei hingegen nicht exportf\u00e4hig. Sachleistungen seien grunds\u00e4tzlich nur vom Wohnortsozialversicherungstr\u00e4ger zu gew\u00e4hren. Eine Ausnahme gelte lediglich f\u00fcr Ruhestandsbeamte und ihnen Gleichgestellte. Der Kl\u00e4ger sei jedoch weder Ruhestandsbeamter noch ihnen gleichgestellt.<\/p>\n<p>Dieses Ergebnis widerspreche insbesondere nicht dem Gleichbehandlungsgrundsatz, da das Versicherungssystem f\u00fcr Beamte und das f\u00fcr sonstige privat oder gesetzlich pflegepflichtversicherte Personen erhebliche Unterschiede aufweise.
