Er kann den Kaufvertrag r\u00fcckabwickeln.<\/p>\n<p>So entschied es das <a href=\"http:\/\/www.olg-oldenburg.de\/\" target=\"_blank\" rel=\"noopener\">Oberlandesgericht (OLG) Oldenburg<\/a> im Fall eines Ehepaars, das von einem H\u00e4ndler ein Wohnmobil f\u00fcr rund 42.000 EUR gekauft hatte. Von Anfang an, so das Ehepaar, h\u00e4tte das Wohnmobil beim Start \u201egeruckelt\u201c. Deswegen wollten sie den Kaufvertrag r\u00fcckg\u00e4ngig machen. Der H\u00e4ndler vertrat die Auffassung, ein zeitweiliges Ruckeln stelle keinen Sachmangel im Rechtssinne dar. So etwas sei als reiner \u201eKomfortmangel\u201c hinzunehmen und letztlich unerheblich.<\/p>\n<p>Das Ehepaar klagte und bekam recht. Nach den Feststellungen eines gerichtlichen Sachverst\u00e4ndigen trete bei Fahrten bei Au\u00dfentemperaturen zwischen 13 und 18 Grad Celsius und bei einer Motordrehzahl zwischen 1.500 und 2.000 Umdrehungen kurz vor Erreichen der Betriebstemperatur ein Motorruckeln auf. Mit Erreichen der Betriebstemperatur verschwinde es wieder. Dies entspreche nicht den berechtigten Erwartungen eines verst\u00e4ndigen K\u00e4ufers. Es sei daher ein Mangel, so die Richter. Dabei falle ins Gewicht, dass es sich vorliegend um ein Neufahrzeug zu einem nicht unerheblichen Preis handele. Es liege auch nicht nur ein \u201eKomfortmangel\u201c vor, zumal w\u00e4hrend des Ruckelns die Zugkraft des Motors sp\u00fcrbar unterbrochen werde und daher zeitweise nur eine reduzierte Motorkraft vorhanden sei.<\/p>\n<p>Der Mangel sei auch nicht geringf\u00fcgig und unerheblich. Denn nach den Feststellungen des Sachverst\u00e4ndigen sei bei den in Deutschland \u00fcblichen Temperaturen fast bei jedem Kaltstart mit einem Ruckeln zu rechnen. Dar\u00fcber hinaus sei die eigentliche Ursache nicht gekl\u00e4rt. Die Eheleute d\u00fcrften daher die berechtigte Bef\u00fcrchtung haben, dass es langfristig zu Motorsch\u00e4den kommen k\u00f6nne.<\/p>\n<p>Vor diesem Hintergrund k\u00f6nnten die Eheleute die R\u00fcckabwicklung des Kaufvertrags verlangen. Sie k\u00f6nnen also das Wohnmobil an den H\u00e4ndler zur\u00fcckgeben und erhalten den Kaufpreis erstattet.
