Der n\u00f6tige Verf\u00fcgungsgrund f\u00fcr eine solche Leistungsverf\u00fcgung ist aber nur gegeben, wenn eine verbotene Eigenmacht oder eine konkrete Gefahr f\u00fcr Leib oder Leben vorliegt.<\/p>\n<p>Das ist das Ergebnis eines Rechtsstreits vor dem <a href=\"http:\/\/www.ag-brandenburg.brandenburg.de\/\" target=\"_blank\" rel=\"noopener noreferrer\">Amtsgericht Brandenburg<\/a>. Der Vermieter wollte im gesamten Wohnhaus umfassende Sanierungs- und Modernisierungsma\u00dfnahmen durchf\u00fchren. Er k\u00fcndigte dem einzigen im Haus noch verbliebenen Altmieter fristlos, hilfsweise fristgem\u00e4\u00df wegen vermeintlicher Verst\u00f6\u00dfe gegen die Hausordnung. Sodann begehrte er im Wege der einstweiligen Verf\u00fcgung die R\u00e4umung und Herausgabe. Die Gefahr f\u00fcr Leib und Leben begr\u00fcndete der Vermieter damit, dass<\/p>\n<ul>\n<li>angeblich mehrfach Schnaps- und Weinflaschen aus dem Fenster der Wohnung des Mieters geflogen waren und zu bef\u00fcrchten stand, dass Passanten oder Nachbarn hierdurch getroffen w\u00fcrden.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Au\u00dferdem h\u00e4tte der Mieter diverse Lebensmittel in den Abfluss gestopft, was zudem die Gefahr begr\u00fcnde, dass er sich eventuell auch noch an der Gasversorgung zu schaffen mache.<\/li>\n<\/ul>\n<p>Das Amtsgericht hat den Antrag des Vermieters zur\u00fcckgewiesen. Es ist davon ausgegangen, dass die Anforderungen an den Verf\u00fcgungsgrund \u2013 angesichts der besonderen Bedeutung einer Wohnung und der bei einer R\u00e4umung eintretenden Vorwegnahme der Hauptsache \u2013 hoch anzusetzen sind.<\/p>\n<p>Ausgehend hiervon hat es den Vortrag des Vermieters zur konkreten Gefahr durch herabfallende Flaschen als nicht hinreichend dargelegt bzw. glaubhaft gemacht angesehen. Die benannten Zeugen h\u00e4tten nur bekunden k\u00f6nnen, dass leere Flaschen vor dem Haus lagen, aber nicht wie sie dort hingekommen waren.
