Die Richter machten deutlich, dass man in einem solchen Fall nicht automatisch davon ausgehen k\u00f6nne, dass der Erblasser das Testament vernichtet hat und es deshalb als widerrufen gilt. Es sei n\u00e4mlich nicht lebensfremd, dass Testamente auch bei sorgf\u00e4ltiger Suche nach dem Tod einer Person zun\u00e4chst nicht auffindbar sind. Sp\u00e4ter w\u00fcrden sie aber oft zuf\u00e4llig an einem Ort gefunden, wo mit einem Testament oder einer Kopie des Testaments nicht unbedingt zu rechnen war.<\/p>\n<p>Will sich jemand auf das \u2013 nicht auffindbare \u2013 Testament berufen, muss er darlegen und beweisen, dass dieses Testament auch tats\u00e4chlich formg\u00fcltig errichtet wurde. Au\u00dferdem muss er den Nachweis erbringen, dass er selber darin als Erbe eingesetzt wurde.
