Sie ist deshalb in einem Gewerbegebiet nicht zul\u00e4ssig.<\/p>\n<p>Dies hat das Oberverwaltungsgericht (OVG) Rheinland-Pfalz im Fall einer Kl\u00e4gerin entschieden, die in einem Gewerbegebiet eine ehemalige Lagerhalle als \u201eSportanlage f\u00fcr Lasertag und Fitness\u201c betreiben m\u00f6chte. Bei Lasertag oder Lasergame handelt es sich um ein Spiel, bei dem mehrere Spieler einen Infrarotsignalgeber (\u201ePhaser\u201c) erhalten sowie mit Sensoren ausgestattete Westen tragen. Die Spieler versuchen, den jeweiligen Gegner mit dem Phaser zu treffen, um so Punkte f\u00fcr sich oder ihre Mannschaft zu sammeln. Die Kl\u00e4gerin beantragte die baurechtliche Genehmigung der Nutzungs\u00e4nderung. Sie vertrat die Auffassung, bei Lasertaganlagen handle es sich um Anlagen f\u00fcr sportliche Zwecke, die in einem Gewerbegebiet allgemein zul\u00e4ssig seien.<\/p>\n<p>Die Bauordnungsbeh\u00f6rde lehnte den Antrag ab. Auch vor dem Verwaltungsgericht Neustadt hatte die Kl\u00e4gerin in erster Instanz keinen Erfolg. Ihre Klage wurde dort abgewiesen. Das OVG hat dieses Urteil nun best\u00e4tigt und die Berufung der Kl\u00e4gerin zur\u00fcckgewiesen. Bei der geplanten Anlage handle es sich um eine Vergn\u00fcgungsst\u00e4tte, nicht um eine Anlage f\u00fcr sportliche Zwecke. Selbst wenn je nach Ausgestaltung des Spiels und individuellem Engagement das Lasertag-Spiel mit schnellen Bewegungen und k\u00f6rperlicher Anstrengung verbunden sein k\u00f6nne, stehe typischerweise die Unterhaltung im Vordergrund. Bei der vorliegend allein interessierenden Indoor-Variante finde das Spiel in einer Phantasiekulisse statt, zu der die Abdunklung des Raumes und der Einsatz von Lichteffekten beitr\u00fcgen. Hinzu k\u00e4men eine akustische Untermalung und synthetisch erzeugte Schussger\u00e4usche. Hierdurch werde eine virtuelle Atmosph\u00e4re geschaffen, die ma\u00dfgeblich f\u00fcr den Spieleindruck sei. Die Ausgestaltung der Spiele erinnere an ein Computerspiel mit der Besonderheit, dass sich der Spieler selbst auf der Spielfl\u00e4che bewege.<\/p>\n<p>Bei der von der Kl\u00e4gerin geplanten Anlage handle es sich au\u00dferdem um eine kerngebietstypische Vergn\u00fcgungsst\u00e4tte, die f\u00fcr ein gr\u00f6\u00dferes und allgemeines Publikum erreichbar sein solle. Das ergebe sich etwa aus der Lage der Halle unmittelbar an der Ausfahrt von einer \u00fcber\u00f6rtlichen Verbindungsstra\u00dfe und der Tatsache, dass sich in der N\u00e4he des geplanten Standortes nur in geringem Umfang Wohnbebauung befinde. Die Anlage sei zudem vor allem auf die Nutzung durch Besuchergruppen angelegt.
