In dem Fall wurde einem 53-j\u00e4hrigen Motorradfahrer bei einer privaten Fahrt von einem Fahrradfahrer die Vorfahrt genommen. Bei dem Ausweichvorgang kam der Motorradfahrer zu Fall. Er verletzte sich unter anderem an den Schultergelenken. Die Unfallkasse lehnte es ab, dieses Ereignis als ent\u00adsch\u00e4digungspflichtigen Arbeitsunfall anzuerkennen. Angesichts der kurzen Reaktionszeit und der hohen Verletzungsgefahr f\u00fcr den Motorradfahrer selbst k\u00f6nne keine Rettungsabsicht festgestellt werden.<\/p>\n<p>Auf die Klage des Motorradfahrers verurteilte das SG die Unfallkasse NRW, das Unfallereignis als Arbeitsunfall anzuerkennen. Unfallversicherungsschutz bestehe nach dem Gesetz auch f\u00fcr Personen, die bei Ungl\u00fccksf\u00e4llen oder gemeiner Gefahr oder Not Hilfe leisten oder einen anderen aus erheblicher gegenw\u00e4rtiger Gefahr f\u00fcr seine Gesundheit retten. Dieser Tatbestand sei hier erf\u00fcllt. Der Kl\u00e4ger habe, indem er seinem potenziellen Unfallgegner ausgewichen sei, diesen aus erheblicher Gefahr f\u00fcr dessen Gesundheit gerettet.
