{"id":7597,"date":"2016-12-31T11:31:18","date_gmt":"2016-12-31T10:31:18","guid":{"rendered":"http:\/\/www.ra-herren.de\/?p=7597"},"modified":"2016-12-31T11:31:18","modified_gmt":"2016-12-31T10:31:18","slug":"nachbarschutz-stiftung-darf-hoffnungshaus-zur-anschlussunterbringung-von-fluechtlingen-bauen","status":"publish","type":"post","link":"https:\/\/raherren.de\/index.php\/2016\/12\/31\/nachbarschutz-stiftung-darf-hoffnungshaus-zur-anschlussunterbringung-von-fluechtlingen-bauen\/","title":{"rendered":"Nachbarschutz: Stiftung darf \u201eHoffnungshaus\u201c zur Anschlussunterbringung von Fl\u00fcchtlingen bauen"},"content":{"rendered":"<p>Das <a href=\"http:\/\/www.vgstuttgart.de\/\" target=\"_blank\" rel=\"noopener\">Verwaltungsgericht (VG) Stuttgart<\/a> hat den Eilantrag von Nachbarn gegen die der Hoffnungstr\u00e4ger Stiftung erteilten Baugenehmigung zur Errichtung eines \u201eWohngeb\u00e4udes zur integrativen Unterbringung von Fl\u00fcchtlingen in Anschlussunterbringung, Bewohnern mit Wohnberechtigungsschein und Obdachlosen\u201c und sechs Stellpl\u00e4tzen in Berkheim\/Esslingen abgelehnt.<\/p>\n<p>Die Nachbarn hatten darauf verwiesen, dass ihr Gebietserhaltungsanspruch durch das geplante Bauvorhaben verletzt werde. Das VG f\u00fchrte aus, dass das genehmigte Vorhaben aller Voraussicht nach nicht gegen nachbarsch\u00fctzende Vorschriften versto\u00dfe. Mit dem Gebietserhaltungsanspruch k\u00f6nnen die Antragsteller nicht durchdringen. Da das geplante Vorhaben und das Grundst\u00fcck der Antragsteller nicht in demselben Baugebiet l\u00e4gen, h\u00e4tten sie keinen Anspruch auf Bewahrung der dort festgesetzten Gebietsart.<\/p>\n<p>Auch das Gebot der R\u00fccksichtnahme sei nicht verletzt. Es d\u00fcrfe zwar zutreffen, dass das geplante Vorhaben massiver sei als die im angrenzenden Baugebiet vorhandenen Geb\u00e4ude. Es gebe jedoch keine Anhaltspunkte daf\u00fcr, dass das Vorhaben eine das Nachbargrundst\u00fcck geradezu \u201eerdr\u00fcckende Wirkung\u201c entfalten k\u00f6nne. Zwischen dem Grundst\u00fcck der Antragsteller und dem geplanten Fl\u00fcchtlingswohnheim liege ein Abstand von 12,5 m.
