Wie aber ist es, wenn der Grenzwert nur ein klitzekleines bisschen \u00fcberschritten ist? Kann man darauf hoffen, dass das Gericht dann ein Auge zudr\u00fcckt nach dem Motto: Fast n\u00fcchtern ist so gut wie ganz n\u00fcchtern?<\/p>\n<p>Keineswegs, wie eine Entscheidung des <a href=\"https:\/\/www.justiz.bayern.de\/gericht\/olg\/ba\/\" target=\"_blank\" rel=\"noopener\">Oberlandesgerichts (OLG) Bamberg<\/a> zeigt. In dem zu entscheidenden Fall hatte der Autofahrer 0,54 Promille Alkohol im Blut, was das zun\u00e4chst entscheidende Amtsgericht zum Anlass nahm, das im Bu\u00dfgeldbescheid noch verh\u00e4ngte Fahrverbot gegen Erh\u00f6hung der Geldbu\u00dfe wegfallen zu lassen. Zu Unrecht, wie das OLG Bamberg befand. Das Gericht verwies darauf, dass bei Ordnungswidrigkeiten nach \u00a7 25a StVG, also beim F\u00fchren eines Kraftfahrzeugs mit einer Blutalkoholkonzentration von 0,5 Promille oder mehr, regelm\u00e4\u00dfig ein Fahrverbot zu verh\u00e4ngen ist. Angesichts des h\u00f6heren Unrechtsgehalts und der Gef\u00e4hrlichkeit einer derartigen Ordnungswidrigkeit verstehe sich die grunds\u00e4tzliche Angemessenheit eines Fahrverbots regelm\u00e4\u00dfig von selbst, argumentierten die Richter. Da sie auch sonst keine schwerwiegenden Gr\u00fcnde f\u00fcr einen Wegfall des Fahrverbots erkennen konnten, hoben sie das Urteil des Amtsgerichts auf.<\/p>\n<p>Fazit: Das Herantrinken an Promillegrenzen ist f\u00fcr Autofahrer gef\u00e4hrlich.
