Voraussetzung ist aber, dass durch Zeugen belegt werden kann, dass das Geld tats\u00e4chlich \u00fcbergeben wurde.<\/p>\n<p>So entschied es das <a href=\"http:\/\/www.fg-baden-wuerttemberg.de\/\" target=\"_blank\" rel=\"noopener\">Finanzgericht (FG) Baden-W\u00fcrttemberg<\/a> im Fall eines Mannes. Dieser hatte einen Bekannten gebeten, seinen 56 bzw. 58 Jahre alten Eltern bei Gesch\u00e4ftsreisen nach S\u00fcditalien Bargeld mitzubringen. Das konnte der Bekannte dem FG so \u00fcberzeugend darlegen, dass es den Sachverhalt im Gegensatz zur Finanzverwaltung nicht in Zweifel zog.<\/p>\n<p><strong>Wichtig\u2002<\/strong>Die Finanzverwaltung will sich mit der Entscheidung aber nicht zufriedengeben. Sie hat Nichtzulassungsbeschwerde eingelegt. Diese wird beim BFH unter dem Az.
