Geklagt hatte ein Gewerbetreibender, dessen Baugenehmigung f\u00fcr das Schild abgelehnt worden war. Das Gericht stellte zun\u00e4chst einmal klar, dass f\u00fcr eine beleuchtete Werbetafel eine Baugenehmigung erforderlich sei. Diese m\u00fcsse erteilt werden, wenn dem Vorhaben \u00f6ffentlich-rechtliche Vorschriften nicht entgegenstehen. Dies sei hier jedoch der Fall. In allgemeinen Wohngebieten erlaube das Baurecht beleuchtete Werbetafeln nur an der St\u00e4tte der Leistung. Werde eine Baugenehmigung f\u00fcr eine andere Stelle beantragt, bestehe kein Anspruch auf Erteilung der Genehmigung. Der Gewerbetreibende k\u00f6nne sich auch nicht darauf berufen, dass sich in der unmittelbaren Umgebung des geplanten Vorhabens andere Werbeanlagen bef\u00e4nden, die ebenfalls den gesetzlichen Vorgaben des Bauordnungsrechts nicht entsprechen w\u00fcrden.
