Hierauf wies das Landesarbeitsgericht (LAG) K\u00f6ln<\/a> im Fall einer jungen Frau hin, die wegen ihrer K\u00f6rpergr\u00f6\u00dfe von 161,5 cm nicht zur Pilotenausbildung zugelassen wurde. Ein Tarifvertrag, der Auswahlrichtlinien f\u00fcr die Pilotenausbildung enth\u00e4lt, sieht eine Mindestgr\u00f6\u00dfe von 165 cm vor. Die Kl\u00e4gerin beruft sich auf das Allgemeine Gleichbehandlungsgesetz (AGG). Sie sieht in der Mindestgr\u00f6\u00dfe eine mittelbare Diskriminierung wegen des Geschlechts, weil Frauen im Durchschnitt kleiner seien als M\u00e4nner. Die Fluggesellschaft hatte sich darauf berufen, die Mindestgr\u00f6\u00dfe sei erforderlich, um Flugzeuge sicher zu steuern.<\/p>\n

Das LAG hat in der m\u00fcndlichen Verhandlung deutlich gemacht, dass es wie das erstinstanzliche Gericht von einer durch sachliche Gr\u00fcnde nicht gerechtfertigten mittelbaren Diskriminierung ausgeht. Es hat darauf hingewiesen, dass andere Fluggesellschaften deutlich geringere Mindestgr\u00f6\u00dfen verlangen. Im Endeffekt hat es die Schadenersatzklage aber gleichwohl abgewiesen, da formelle Voraussetzungen nicht erf\u00fcllt waren (LAG K\u00f6ln, 5 Sa 75\/14).<\/p>\n<\/div>\n
