Vertraglich war der Bautr\u00e4ger verpflichtet, die Wohnung sp\u00e4testens bis zum 31.8.2009 fertigzustellen und zu \u00fcbergeben. Da die Wohnung auch im Herbst 2011 noch nicht bezugsfertig \u00fcbergeben war, klagten die Erwerber unter anderem auf Zahlung einer Nutzungsausfallentsch\u00e4digung f\u00fcr die Zeit vom 1.10.2009 bis zum 30.9.2011. Sie berechneten diese mit einer Vergleichsmiete f\u00fcr die vorenthaltene Wohnung. Dabei wollten sie sich die vom Bautr\u00e4ger ohnehin zu erstattende Miete f\u00fcr die bisherige, weiter von ihnen bewohnte Wohnung anrechnen lassen.<\/p>\n<p>Das Berufungsgericht hat den Anspruch der Erwerber auf Nutzungsausfallentsch\u00e4digung unter Abzug eines 30-prozentigen Abschlags f\u00fcr Vermietergewinn und bei privater Nutzung sonst nicht anfallende Kosten bejaht. Die Revision des Bautr\u00e4gers hatte keinen Erfolg. Der BGH entschied, dass der Erwerber f\u00fcr die Dauer eines l\u00e4ngeren Verzugs des Bautr\u00e4gers mit der \u00dcbergabe einer von ihm noch herzustellenden Wohnung eine Entsch\u00e4digung f\u00fcr die entgangene Nutzung verlangen k\u00f6nne. Voraussetzung sei, dass ihm in dieser Zeit anderweitiger, in etwa gleichwertiger Wohnraum nicht zur Verf\u00fcgung stehe. Letzteres sei hier nicht der Fall gewesen, weil die bisher genutzte Wohnung lediglich 72 qm Wohnfl\u00e4che umfasse.
