So entschied es das Oberlandesgericht (OLG) Koblenz<\/a> im Fall eines Patienten, bei dem die Insertion des Implantats 37 fehlerhaft erfolgt war, weil der beklagte Implantologe eine falsche Bezugsebene f\u00fcr die L\u00e4ngenbestimmung gew\u00e4hlt hatte. Damit war das Implantat zu gro\u00df ausgefallen. Dies f\u00fchrte in der Folge zu einer Nervensch\u00e4digung. Ob ein Dauerschaden verbleibe, sei f\u00fcr das Gericht noch nicht sicher abzusehen. In jedem Fall sei ein Schmerzensgeld in H\u00f6he von 5.000 EUR angemessen, weil der Patient unter starken Nervenschmerzen und anschlie\u00dfend fortdauernd unter Gef\u00fchlsbeeintr\u00e4chtigungen leiden musste. Nicht mehr korrigieren lasse sich auch der Umstand, dass das Implantat zu gro\u00df sei (OLG Koblenz, 5 U 1212\/13).<\/p>\n<\/div>\n
