Hierauf wies das Oberlandesgericht (OLG) Karlsruhe<\/a> im Fall eines Mannes hin, der ein Wohnhaus hatte errichten lassen. Erst nach \u00fcber zehn Jahren stellte er einen Mangel an der W\u00e4rmed\u00e4mmung fest. Die erforderlichen Sanierungskosten wollte er von dem Bauunternehmer ersetzt bekommen. Die Richter am OLG wiesen seine Klage jedoch ab. Es gelte die im Gesetz vorgesehene Verj\u00e4hrungsfrist von zehn Jahren. Diese beginne mit Abnahme der Bauleistung. Dabei sei unerheblich, ob der Bauunternehmer arglistig den Mangel verschwiegen habe. Werde der Mangel erst nach Ablauf der zehn Jahre entdeckt, seien auch in diesem Fall Nacherf\u00fcllungs- oder Schadenersatzanspr\u00fcche verj\u00e4hrt (OLG Karlsruhe, 4 U 149\/13<\/a>).<\/p>\n<\/div>\n
