\"Accident<\/a>Die Beteiligten eines sogenannten Streifunfalls beim \u00dcberholvorgang in einer Autobahnbaustelle haften jeweils zur H\u00e4lfte f\u00fcr den eingetretenen Schaden.<\/p>\n

So entschied es das Oberlandesgericht (OLG) Oldenburg<\/a> im Fall eines Autofahrers, der einen Lkw mit Anh\u00e4nger in einer Autobahnbaustelle \u00fcberholen wollte. Vor dem \u00dcberholvorgang war der Lkw bereits einmal von der rechten Hauptfahrspur \u00fcber die Fahrbahnmarkierung teilweise auf den linken Fahrstreifen geraten. W\u00e4hrend des \u00dcberholvorgangs auf den verengten Fahrbahnen stie\u00dfen die beiden Fahrzeuge sodann aneinander. Es entstand am Pkw ein Sachschaden in H\u00f6he von mehr als 5.000 EUR.<\/p>\n

Das Landgericht Osnabr\u00fcck<\/a> hatte die Klage des Autofahrers auf Schadenersatz abgewiesen. Mit seiner Berufung hatte er jetzt zur H\u00e4lfte Erfolg. Aus Sicht der Richter am OLG konnte der konkrete Unfallhergang mangels Zeugen nicht aufgekl\u00e4rt werden. So blieb offen, ob der Lkw zu weit links auf die \u00dcberholspur gefahren war oder der Autofahrer nicht aufgepasst hatte. Ein Autofahrer d\u00fcrfe im Baustellenbereich \u00fcberholen, solange dies nicht verboten sei, so das OLG. Eine im Verh\u00e4ltnis zum Lkw-Fahrer gesteigerte Sorgfaltspflicht treffe ihn nicht, da auch der Lkw-Fahrer besondere Sorgfalt walten lassen m\u00fcsse. Selbst wenn der Lkw zuvor bereits seinen Hauptfahrstreifen einmal verlassen habe und zu weit links gefahren sei, k\u00f6nne darauf vertraut werden, dass dies beim \u00dcberholvorgang nicht noch einmal passieren werde (OLG Oldenburg, 6 U 64\/12<\/a>).<\/p>\n<\/div>\n
