Geklagt hatte der Eigent\u00fcmer eines Grundst\u00fccks, auf dem sich Geb\u00e4udereste befanden. Er war vom Landkreis verpflichtet worden, diese Geb\u00e4udereste sofort vollziehbar zu beseitigen.<\/p>\n<p>Sein Antrag auf vorl\u00e4ufigen Rechtsschutz war erfolgreich. Zwar best\u00fcnden, so die Richter, keine Zweifel an der Rechtm\u00e4\u00dfigkeit des angeordneten Abbruchs. Das Anwesen werde seit Jahren nicht mehr zweckentsprechend genutzt und sei ebenso lange im Verfall begriffen. Im Eilverfahren d\u00fcrfe aber die Dringlichkeit der angeordneten Ma\u00dfnahme nicht au\u00dfer Betracht bleiben. Eine Dringlichkeit des Abrisses s\u00e4mtlicher Geb\u00e4udereste ergebe sich vorliegend weder aus der Begr\u00fcndung der Abbruchverf\u00fcgung noch aus den Verwaltungsakten. Unklar bleibe, weshalb entgegen fr\u00fcherer Einsch\u00e4tzungen des Landkreises ein Komplettabriss statt sonstiger Sicherungsma\u00dfnahmen notwendig sei. Der Antragsgegner habe auch nicht nachvollziehbar dargelegt, dass eine Gefahr f\u00fcr Leib und Leben von Personen nur durch den sofortigen Abriss des gesamten Geb\u00e4udetorsos gebannt werden k\u00f6nne. Vielmehr spreche sein bisheriges Verhalten gegen die Annahme einer akuten Gef\u00e4hrdung. So sei nach einer Ortsbesichtigung noch eine mehrmonatige Frist zur Beseitigung einger\u00e4umt worden. Gegen die Annahme der Dringlichkeit spreche zudem die weitere Zwei-Monats-Frist in der Verf\u00fcgung.
