Der Autofahrer wird froh sein, denn so wird sein Schadenfreiheitsrabatt nicht belastet. Allerdings ist diese Frage sehr umstritten und die Rechtsprechung ist nicht einheitlich. Der Gesch\u00e4digte kann zwar einfach den Sch\u00e4diger in Person in Anspruch nehmen. Bei welcher Versicherung der den Schaden dann unterbringt, kann ihm gleichg\u00fcltig sein.
