Die B\u00fcrgschaft sichert daher grunds\u00e4tzlich nur Verbindlichkeiten bestimmter Personen.<\/p>\n<p>Hierauf wies das Oberlandesgericht (OLG) Frankfurt a.M. in einem entsprechenden Rechtsstreit hin. Die Richter machten deutlich, dass daher eine Haftung aus der B\u00fcrgschaft grunds\u00e4tzlich ausgeschlossen sei, wenn ein anderer an die Stelle des urspr\u00fcnglichen Hauptschuldners trete.<\/p>\n<p>Hinweis: Eine solche Fallgestaltung ist oft anzutreffen, wenn ein Bauunternehmer mit anderen eine ARGE eingeht.
