Sp\u00e4ter stellte sich heraus, dass ein teilweise immer noch vorhandener &#8222;schwerster Schaden mit Beeintr\u00e4chtigung der Fahrzeugstruktur&#8220; vorlag. Die Richter machten deutlich, dass dies ein Mangel des Pkw sei. Dieser berechtige den K\u00e4ufer zum R\u00fccktritt vom Kaufvertrag. Dem stehe der vereinbarte Gew\u00e4hrleistungsausschluss nicht entgegen, weil dieser jegliche Gew\u00e4hrleistung ohne Ausnahme ausschlie\u00dfe.
