Dies hat das Verwaltungsgericht (VG) K\u00f6ln entschieden und den Eilantrag eines Unternehmers gegen eine Untersagungsverf\u00fcgung der Stadt K\u00f6ln abgelehnt.<\/p>\n<p><strong>Mann vertrieb eingepflanzte Cannabisjungspflanzen<\/strong><\/p>\n<p>Der Antragsteller vertreibt \u00fcber ein Ladenlokal in K\u00f6ln und einen Online-Shop diverse Produkte mit Bezug zum Anbau und Konsum von Cannabis. Hierzu z\u00e4hlen unter anderem eingepflanzte Cannabisjungpflanzen, die er auf seiner Website als \u201eStecklinge\u201c bezeichnet.<\/p>\n<p><strong>Stadt untersagte den Handel<\/strong><\/p>\n<p>Die Stadt K\u00f6ln untersagte dem Antragsteller den Handel mit diesen Pflanzen. Zur Begr\u00fcndung f\u00fchrte sie unter anderem aus, Stecklinge d\u00fcrften nach dem neuen Konsumcannabisgesetz (KCanG) nur durch Anbauvereinigungen, nicht aber im gewerblichen Handel weitergegeben werden.<\/p>\n<p>&nbsp;<\/p>\n<p>Hiergegen wandte sich der Antragsteller mit seinem Eilantrag und trug vor, es handle sich bei den Pflanzen lediglich um Vermehrungsmaterial, dessen Weitergabe auch gewerblichen Anbietern erlaubt sei.<\/p>\n<p><strong>Verwaltungsgericht best\u00e4tigte Stadt<\/strong><\/p>\n<p>Dem ist das Gericht nicht gefolgt. Mit dem Verkauf der eingepflanzten Cannabisjungpflanzen verst\u00f6\u00dft der Antragsteller gegen das Verbot des Handeltreibens mit Cannabis.<\/p>\n<p>Ein Steckling im Sinne des KCanG liegt nur vor, wenn die Jungpflanze noch nicht eingepflanzt ist. Wird der Steckling eingepflanzt und damit angebaut, handelt es sich um Cannabis, dessen gewerblicher Vertrieb untersagt ist. Dies gilt auch wenn die Jungpflanze noch nicht \u00fcber Bl\u00fcten- oder Fruchtst\u00e4nde verf\u00fcgt.
