Dies hat das Bundessozialgericht (BSG) heute entschieden.<\/p>\n<p><strong>Vom Wochenendausflug zur Wohnung gefahren und verungl\u00fcckt<\/strong><br \/>\nDie Kl\u00e4gerin fuhr am Unfalltag fr\u00fch morgens nach einem privaten Wochenendausflug von dort zur\u00fcck zu ihrer Wohnung, in der sich Schl\u00fcssel und Unterlagen f\u00fcr ihren anschlie\u00dfenden Arbeitseinsatz bei der Er\u00f6ffnung eines Gemeindezentrums befanden. Wenige Kilometer vor ihrem Wohnort verungl\u00fcckte die Kl\u00e4gerin mit ihrem Pkw und wurde schwer verletzt.<\/p>\n<p><strong>Arbeitsunfall oder nicht?<\/strong><br \/>\nDie beklagte Berufsgenossenschaft und die Vorinstanzen lehnten die Anerkennung eines Arbeitsunfalls ab. Die Revision der Kl\u00e4gerin war erfolgreich. Die Kl\u00e4gerin kann sich auf einem versicherten Betriebsweg befunden haben, wenn sie den Weg zur Aufnahme von Arbeitsschl\u00fcsseln und -unterlagen in ihrer Wohnung in Umsetzung einer Weisung ihres Arbeitsgebers zur\u00fcckgelegt hat.
