Die Richter begr\u00fcndeten ihre Entscheidung damit, dass anderenfalls ein Anreiz bestehe, nicht zugelassene Nutzungen bis zum Eintritt der Bestandskraft einer beh\u00f6rdlichen Ordnungsverf\u00fcgung aufzunehmen und auch fortzuf\u00fchren. Wegen der sonst aufschiebenden Wirkung der Klage und einer in der Regel langen Prozessdauer k\u00f6nnte die illegale Nutzung so m\u00f6glicherweise \u00fcber Jahre betrieben werden. Das w\u00fcrde nicht nur die Ordnungsfunktion des Bauaufsichtsrechts entwerten.
