Anderenfalls kann die Wohnungseigent\u00fcmergemeinschaft beschlie\u00dfen, dass das Ger\u00e4t entfernt werden muss.<\/p>\n<p>Das best\u00e4tigte das Oberlandesgericht (OLG) D\u00fcsseldorf im Fall einer Wohnanlage, die aus 14 Wohnungen und drei Gewerbeeinheiten bestand. Einer der Eigent\u00fcmer montierte an der Au\u00dfenfassade eine Klimaanlage. Das brachte die anderen Eigent\u00fcmer auf den Plan. Sie bem\u00e4ngelten, dass das Ger\u00e4t optisch nicht zur Fassade passe. Zudem seien die Betriebsger\u00e4usche st\u00f6rend, insbesondere in der Nacht. In der Eigent\u00fcmerversammlung wurde daher beschlossen, dass das Ger\u00e4t entfernt werden m\u00fcsse. Das wiederum wollte der betroffene Eigent\u00fcmer nicht und zog vor Gericht.<\/p>\n<p>Mit seiner Klage hatte er jedoch keinen Erfolg. Die Richter verdeutlichten ihm, dass die Montage seiner Klimaanlage eine bauliche Ver\u00e4nderung sei. Hierf\u00fcr m\u00fcsse er die Zustimmung der Wohnungseigent\u00fcmergemeinschaft einholen. Da er das nicht getan habe, sei der Beseitigungsbeschluss rechtm\u00e4\u00dfig. Dagegen spreche auch nicht, dass m\u00f6glicherweise ein Betriebsverbot w\u00e4hrend der Nachtzeit ausgereicht h\u00e4tte. Der Eigent\u00fcmergemeinschaft stehe ein Gestaltungsspielraum zu.
