Ist unsicher, ob die Ankunftsversp\u00e4tung mindestens drei Stunden betragen hat, ist das Luftfahrtunternehmen gehalten, die ihm zur Verf\u00fcgung stehenden Informationen mitzuteilen, die R\u00fcckschl\u00fcsse auf den ma\u00dfgeblichen Zeitpunkt erm\u00f6glichen. So sieht es der <a href=\"http:\/\/www.bundesgerichtshof.de\" target=\"_blank\" rel=\"noopener\">Bundesgerichtshof (BGH)<\/a>.<\/p>\n<p>Danach enth\u00e4lt die Fluggastrechte-Verordnung (Fluggastrechte-VO) keine Bestimmung \u00fcber die Darlegungs- und Beweislast hinsichtlich des Umfangs der Versp\u00e4tung. Es gelte deshalb deutsches Beweisrecht.
