Das hat jetzt das Oberlandesgerichts (OLG) Koblenz entschieden und damit das erstinstanzliche Urteil des Amtsgerichts (AG) Mainz best\u00e4tigt.<\/p>\n<p>Das AG hatte gegen den Betroffenen eine Geldbu\u00dfe und ein Fahrverbot verh\u00e4ngt. Er habe au\u00dferhalb geschlossener Ortschaften die zul\u00e4ssige Geschwindigkeit um 31 km\/h \u00fcberschritten. Es gab einschl\u00e4gige Voreintragungen. Der Betroffene hatte demgegen\u00fcber u. a. beanstandet, dass die Bu\u00dfgeldbeh\u00f6rde vor Erlass des Bu\u00dfgeldbescheids sein Personalausweisfoto zur Fahreridentifizierung beim Einwohnermeldeamt angefordert habe. Dessen Herausgabe versto\u00dfe gegen das Gesetz. Daher sei das Verfahren einzustellen.<\/p>\n<p>Damit hatte der Betroffene vor dem OLG keinen Erfolg. Es erkannte keinen Gesetzesversto\u00df. Das Einwohnermeldeamt habe das Foto nach den Regelungen des Personalausweisgesetzes (PAuswG) an die Bu\u00dfgeldbeh\u00f6rde herausgeben d\u00fcrfen.
