Es widerspricht nicht dessen typischer Funktion. So entschied jetzt der <a href=\"https:\/\/www.vgh.bayern.de\/bayvgh\/\" target=\"_blank\" rel=\"noopener noreferrer\">Verwaltungsgerichtshof (VGH) Bayern<\/a>.<\/p>\n<p>Dies widerspreche auch nicht dem Gebot der R\u00fccksichtnahme. Welche Anforderungen dieses Gebot begr\u00fcndet, h\u00e4nge wesentlich von den jeweiligen Umst\u00e4nden ab. Je empfindlicher und schutzw\u00fcrdiger die Stellung desjenigen ist, dem die R\u00fccksichtnahme im gegebenen Zusammenhang zugutekommt, umso mehr kann er an R\u00fccksichtnahme verlangen.<\/p>\n<p>Hier h\u00e4tten sich weder aus dem Vortrag der Kl\u00e4gerin noch aus den vorgelegten Beh\u00f6rdenakten Anhaltspunkte daf\u00fcr ergeben, dass ein geplanter Bordellbetrieb nach Anzahl, Lage, Umfang oder Zweckbestimmung der Eigenart des Baugebiets widerspreche.
