Der Bundesfinanzhof (BFH)<\/a> hat entschieden, dass Eltern f\u00fcr ein Kind, das an einem Freiwilligendienst im Rahmen des Europ\u00e4ischen Programms \u201eErasmus+\u201c teilnimmt, nur Kindergeld erhalten, wenn der Dienst im Rahmen eines von einer Nationalen Agentur genehmigten Projekts durchgef\u00fchrt wird.<\/p>\n

Ein Kind absolvierte nach dem Ende seiner Schulausbildung ab September 2018 einen Freiwilligendienst im Europ\u00e4ischen Ausland bei einer Organisation, die als Veranstalter f\u00fcr das von der Europ\u00e4ischen Union eingerichtete Programm \u201eErasmus+\u201c registriert und akkreditiert war. Die Familienkasse lehnte die Weitergew\u00e4hrung von Kindergeld ab. Die dagegen vom Vater eingelegte Klage war vor dem Finanzgericht (FG) Sachsen erfolgreich. Auf die Revision der Familienkasse hat der BFH das Urteil nun aufgehoben und die Sache an das FG zur\u00fcckverwiesen.<\/p>\n

Kinder k\u00f6nnen wegen der Teilnahme an einem Freiwilligendienst gem\u00e4\u00df Einkommensteuergesetz (\u00a7 32 EStG) f\u00fcr das Kindergeld nur ber\u00fccksichtigt werden, wenn es sich hierbei um die konkret im EStG und in Verbindung mit den dort genannten Bestimmungen umschriebenen Dienste handelt. Ein Freiwilligendienst im Rahmen des Programms \u201eErasmus+\u201c kann deshalb nur zur Gew\u00e4hrung von Kindergeld f\u00fchren, wenn er nach Ma\u00dfgabe einer EU-Verordnung und den entsprechenden Durchf\u00fchrungsbestimmungen dargelegten Voraussetzungen erf\u00fcllt. Es muss sich danach um eine T\u00e4tigkeit im Rahmen eines gef\u00f6rderten Projekts handeln.<\/p>\n

Ein solches Projekt liegt aber nur vor, wenn es von einer entsprechenden Nationalen Agentur genehmigt worden ist. Nicht ausreichend ist, dass eine Organisation f\u00fcr ein Programm \u201eErasmus+\u201c lediglich registriert und akkreditiert ist. Weil das FG keine Feststellungen dazu getroffen hat, ob das Kind im Rahmen eines von der Nationalagentur anerkannten Projekts t\u00e4tig geworden ist, konnte der BFH nicht abschlie\u00dfend entscheiden und hat die Sache an das Finanzgericht zur\u00fcckverwiesen.<\/p>\n
