Das Verwaltungsgericht (VG) Minden sah die landesrechtliche Allgemeinverf\u00fcgung in Nordrhein-Westfalen als rechtswidrig an, da bei der Entscheidung \u00fcber eine Isolation bei m\u00f6glicher Corona-Infektion eine Beh\u00f6rde einzuschalten ist. Die NRW-Regelung \u00fcberl\u00e4sst die Entscheidung aber direkt den Pflegeeinrichtungen. Dies sei unzul\u00e4ssig.<\/p>\n<p>Das VG vertrat die Ansicht, dass das private Interesse der Heimbewohnerin, von einer Vollziehung der Allgemeinverf\u00fcgung zun\u00e4chst verschont zu bleiben, das \u00f6ffentliche Interesse am Vollzug \u00fcberwiege. Es gab daher ihrem Eilantrag statt. Grundlage war die nordrhein-westf\u00e4lische Allgemeinverf\u00fcgung der CoronaAVPflegeundBesuche, die bei einem konkreten Anlass eine isolierte Pflege und Betreuung betroffener Heimbewohner vorsieht. Das VG sah f\u00fcr eine angeordnete Isolierung keine gesetzliche Grundlage. Das NRW-Ministerium k\u00f6nne sich insoweit auch nicht auf die Generalerm\u00e4chtigung des Infektionsschutzgesetzes beziehen. Denn diese enthalte spezialgesetzliche Regelungen, sodass ein R\u00fcckgriff auf die Generalklausel ausgeschlossen sei. Dar\u00fcber hinaus d\u00fcrfe die Entscheidung \u00fcber eine Isolation nicht allein von der Pflegeeinrichtung getroffen werden.
