Manchmal verarmen sie aber und m\u00fcssen Sozialleistungen beanspruchen. Dann fragt es sich, ob diese Ratenzahlungen Schenkungen sind, die ein Sozialhilfetr\u00e4ger per Regress zur\u00fcckfordern kann. Diese Frage hat das <a href=\"https:\/\/oberlandesgericht-celle.niedersachsen.de\/startseite\/\" target=\"_blank\" rel=\"noopener noreferrer\">Oberlandesgericht (OLG) Celle<\/a> jetzt bejaht.<\/p>\n<p>Eine Gro\u00dfmutter hatte f\u00fcr ihre Enkel ab deren Geburt jeweils ein Sparkonto er\u00f6ffnet. Darauf hatte sie monatliche Betr\u00e4ge eingezahlt. Als sie in eine Pflegeeinrichtung zog, musste sie Sozialhilfeleistungen in Anspruch nehmen. Das Sozialamt verlangte daraufhin von den Enkeln die gezahlten Sparraten der letzten zehn Jahre zur\u00fcck.<\/p>\n<p>Das OLG Celle verurteilte die Enkel entsprechend. Seine Begr\u00fcndung: Die Gro\u00dfmutter zahlte freigebig und im beiderseitigen Bewusstsein, dass dies unentgeltlich geschah. Daher stellten die Zahlungen Schenkungen dar. Daran \u00e4ndert auch nichts, dass sich die Gro\u00dfmutter durch ihre Gro\u00dfz\u00fcgigkeit ggf. erhofft hat, ihre Enkel w\u00fcrden ihr eine gewisse Anerkennung zukommen lassen. Folge: Die Schenkungen konnten Gegenstand einer R\u00fcckforderung im Wege des Sozialhilferegresses sein. Dem konnte nur entgegenstehen, dass es sich um eine Pflicht- oder Anstandsschenkung handelte.
