So soll deren Ausf\u00fchrungsart endg\u00fcltig gekl\u00e4rt werden. Doch was, wenn die Ergebnisse solcher nachtr\u00e4glicher Bemusterungen zum Vertragssoll erhoben werden sollen? Dann m\u00fcssen die Parteien dies eindeutig vereinbaren. So hat es jetzt der <a href=\"http:\/\/www.bundesgerichtshof.de\" target=\"_blank\" rel=\"noopener noreferrer\">Bundesgerichtshof (BGH)<\/a> klargestellt.<\/p>\n<p>Die Parteien hatten einen Vertrag \u00fcber das Herstellen und Liefern von Glaselementen aus Wei\u00dfglas geschlossen. Anl\u00e4sslich eines anschlie\u00dfenden Bemusterungstermins zur Bestimmung der Oberfl\u00e4chenbeschichtung stellte sich heraus, dass Glaselemente aus Gr\u00fcnglas verwendet wurden. Das f\u00fchrt aber laut BGH nicht dazu, dass nun Gr\u00fcnglas geschuldet ist.
