Ja!"},"content":{"rendered":"<p>Wegen der Covid-19-Pandemie stellt eine R\u00e4umungsvollstreckung angesichts der akuten Gesundheitsgefahr f\u00fcr die Bev\u00f6lkerung keine sittenwidrige H\u00e4rte dar. Sie muss daher nicht eingestellt werden. So hat es jetzt das <a href=\"https:\/\/ordentliche-gerichtsbarkeit.hessen.de\/LG-Frankfurt\" target=\"_blank\" rel=\"noopener noreferrer\">Landgericht (LG) Frankfurt<\/a> entschieden.<\/p>\n<p>Der Gerichtsvollzieher hatte den R\u00e4umungstermin bereits festgelegt. Der Schuldner, ein Mieter, begehrte aber R\u00e4umungsschutz. Seinen entsprechenden Antrag wies das Vollstreckungsgericht zur\u00fcck. Hiergegen wandte sich der Schuldner und berief sich auf die von Covid-19 ausgehenden Gefahren. Er geh\u00f6re aufgrund mehrerer Erkrankungen zur Risikogruppe und sei besonders gef\u00e4hrdet. Es bestehe Lebensgefahr. Dar\u00fcber hinaus bestehe ein umfassendes Kontaktverbot, das der R\u00e4umungsvollstreckung entgegenstehe. Selbst die staatliche Zwangseinweisung zur Vermeidung von Obdachlosigkeit beseitige nicht die gegenw\u00e4rtige Infektionsgefahr. Vielmehr w\u00fcrde der Schuldner zahlreichen infekti\u00f6sen Personen ausgesetzt. Das AG gab ihm Recht und stellte die Zwangsr\u00e4umung einstweilen ein. Doch das LG Frankfurt stellte sich auf die Seite des Gl\u00e4ubigers.<\/p>\n<p>Beachten Sie | Hier war der Gl\u00e4ubiger und Vermieter 82 Jahre alt. Er hatte auch gesundheitliche Gesichtspunkte angef\u00fchrt, die f\u00fcr eine schnellstm\u00f6gliche R\u00e4umung sprachen. Zudem hatte der Schuldner nie Miete gezahlt und so den Gl\u00e4ubiger in seiner finanziellen Existenz gef\u00e4hrdet. Au\u00dferdem hatte der Schuldner die \u00fcbrigen Hausbewohner bedroht, beschimpft und k\u00f6rperlich angegriffen. Hinzu kam: Noch weitere Hausbewohner waren \u00fcber 70 und 80 Jahre alt. Auch sie z\u00e4hlten zur Risikogruppe, die aufgrund des vom Schuldner in seiner Wohnung empfangenen Besuchs einer gesteigerten Gesundheitsgefahr ausgesetzt waren.<\/p>\n<p>Schlie\u00dflich: Es bleibt dem Schuldner selbst \u00fcberlassen, ob er bei der R\u00e4umung anwesend sein will. Mitarbeiter einer Spedition oder Gerichtsvollzieher werden i. d.
