Sein Argument &#8222;nicht pr\u00fcfbare Schlussrechnung&#8220; gegen die Abrechnung ging nicht auf. Der BGH verwies in seiner Urteilsbegr\u00fcndung zwar noch einmal darauf, dass eine Werklohnklage grunds\u00e4tzlich als unbegr\u00fcndet abzuweisen ist, wenn der Bauherr die erteilte Schlussrechnung nicht pr\u00fcfen k\u00f6nne. Das gelte aber nicht, wenn der Bauherr nach Erhalt der Schlussrechnung zwei Monate unt\u00e4tig bleibe und die fehlende Pr\u00fcfbarkeit nicht r\u00fcge. In diesem Fall sei die Werklohnforderung gleichwohl f\u00e4llig. An dieser F\u00e4lligkeit \u00e4ndere sich auch nichts, wenn weitere, nicht pr\u00fcfbare Schlussrechnungen vorgelegt w\u00fcrden. Vielmehr m\u00fcsse eine Sachpr\u00fcfung erfolgen.
