Um sein Hab und Gut zu sichern, lie\u00df der Angeklagte den Gerichtstermin sausen. Daraufhin wies das Berufungsgericht wegen seiner Abwesenheit die Berufung zur\u00fcck. Das OLG entschied nun, dass die Verhandlung nachgeholt werden k\u00f6nne, da der Angeklagte hinreichend entschuldigt war. Allerdings wiesen die Richter auch darauf hin, dass eine anstehende Zwangsr\u00e4umung nicht zwangsl\u00e4ufig dazu f\u00fchre, dass die \u00f6ffentlich-rechtliche Verpflichtung zum Erscheinen in der Hauptverhandlung in einem solchen Fall stets zur\u00fcckzutreten h\u00e4tte. Der Angeklagte m\u00fcsse vielmehr im Rahmen des M\u00f6glichen geeignete Schritte unternehmen, um trotz der angek\u00fcndigten Zwangsr\u00e4umung auch an der Hauptverhandlung teilnehmen zu k\u00f6nnen.
