Diese war f\u00fcr die Anordnung einer Fahrtenbuchauflage ergangen. Begr\u00fcndet wurde die Auflage damit, dass bei einem Geschwindigkeitsversto\u00df mit einem der Fahrzeuge des Unternehmers der Fahrer nicht ermittelt werden konnte.<\/p>\n<p>Das OVG hielt bereits die Fahrtenbuchauflage an sich f\u00fcr unverh\u00e4ltnism\u00e4\u00dfig. Dass der Fahrer nicht ermittelt werden konnte, habe nicht an einer unterlassenen Mitwirkung des Unternehmers gelegen. Vielmehr habe der Fahrer auf dem Bild schlicht nicht erkannt werden k\u00f6nnen. Es trete hinzu, dass der Unternehmer in der Vergangenheit bei Verkehrsverst\u00f6\u00dfen stets alle Fahrer benannt habe. Unter diesen Voraussetzungen den gesamten Fuhrpark mit einer Fahrtenbuchauflage zu belegen, belaste den Unternehmer unverh\u00e4ltnism\u00e4\u00dfig.
