Hieran \u00e4ndert auch das Kopfteilprinzip bei einer gemeinsam bewohnten Wohnung nichts.<\/p>\n<p>Dies entschied das <a href=\"https:\/\/www.justiz.sachsen.de\/lsg\/\" target=\"_blank\" rel=\"noopener noreferrer\">Landessozialgericht (LSG) Sachsen<\/a>. Ein Mietkautionsdarlehen nach dem SGB XII kann \u00e4lteren oder dauerhaft voll erwerbsgeminderten Personen gew\u00e4hrt werden, wenn sie ihren notwendigen Lebensunterhalt nicht oder nicht ausreichend aus eigenen Kr\u00e4ften und Mitteln bestreiten k\u00f6nnen. Dies kann u. a. nur dann erfolgen, wenn die Kosten f\u00fcr die begehrte Wohnung angemessen w\u00e4ren. Dies ist nicht der Fall, wenn die Kosten gegen\u00fcber der bisher bewohnten Wohnung zwar niedriger w\u00e4ren, allerdings die Anmietung nicht einem angemessenen Wohnungsstandard entsprechend den Sozialhilfegrunds\u00e4tzen entspricht.<\/p>\n<p>Hier wollte der Antragsteller eine m\u00f6blierte Wohnung mit einer Komplettausstattung auf gehobenem Niveau mit monatlichem Reinigungsservice anmieten.
