Zwar liegt es bei einer die Grenze absoluter Fahrunsicherheit weit \u00fcbersteigenden Alkoholisierung nahe, dass der T\u00e4ter seine Unf\u00e4higkeit das Fahrzeug sicher zu f\u00fchren, zumindest f\u00fcr m\u00f6glich h\u00e4lt und in Kauf nimmt. Der Schluss auf Vorsatz kann aber nicht allein auf die hohe Blutalkoholkonzentration gest\u00fctzt werden.<\/p>\n<p>Um wegen Vorsatz verurteilen zu k\u00f6nnen, muss das Gericht vielmehr Feststellungen zu Trinkanlass, Trinkverlauf, Fahrtanlass, dem Zusammenhang von Trinkverhalten und Fahrbereitschaft, Fahrtverlauf und Nachtatverhalten treffen.
